These Terms of Service ("Terms") govern the use of the Recruitella platform ("Service") operated by DMKode, company ID 57555516, registered in Slovakia ("Company", "we", "us").
By creating an account or using the Service, the user ("you") agrees to be bound by these Terms. If you do not agree, do not use the Service.
Recruitella is a web-based AI-powered CV screening tool. Users upload job descriptions and candidate CVs. The Service scores, ranks, and summarises candidates using artificial intelligence. Results are provided for informational purposes to assist — not replace — human hiring decisions.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must be at least 18 years old and have the legal authority to enter into these Terms. If you are acting on behalf of an organisation, you represent that you have authority to bind that organisation.
New accounts receive a free trial of 7 days and up to 100 CV analyses, whichever limit is reached first. No credit card is required.
When the trial expires, the account transitions to read-only access. You may view existing projects and results but cannot create new projects or upload additional CVs. Read-only access remains available until the account is deleted.
Paid plans are billed on a monthly or annual cycle via Stripe. Prices are listed on the pricing page and are denominated in EUR.
Each paid plan includes a monthly credit allowance (1 credit = 1 CV analysed). Monthly credits reset at the start of each billing period. Unused monthly credits do not carry over.
Annual plans are billed as a single upfront payment and include a discount equivalent to two free months.
Additional credits may be purchased as top-up bundles. Top-up credits do not expire and carry over until fully spent or until the account is cancelled. Monthly credits are always consumed before top-up credits.
Top-up credits are non-refundable.
Monthly plans: You may cancel at any time. The subscription remains active until the end of the current billing period. No refund is issued for the remaining days of the current period.
Annual plans: You may cancel at any time. The current month will be completed. Any remaining prepaid credit for unused full months will be calculated and returned to your payment method.
Top-up credit purchases are non-refundable.

Your content: You retain ownership of all content you upload (job descriptions, CVs, attachments). By uploading content, you grant us a limited licence to process it solely for the purpose of providing the Service.
Our content: The Service, its design, features, code, documentation, and branding are owned by DMKode and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of any of our intellectual property to you.
AI-generated output: Reports, scores, and summaries generated by the Service are provided as part of the Service. You may use them internally for hiring decisions. You may not represent AI-generated output as human-authored professional assessments.
We process personal data in accordance with EU General Data Protection Regulation (GDPR) and our Privacy Policy.
Data processing location: All data is stored and processed on servers located in Germany (European Union).
Candidate data: CVs uploaded by users are processed for analysis only. We do not sell, share, or use candidate personal data for any purpose other than providing the Service.
Benchmark data: Anonymised, non-personally-identifiable data (job title, years of experience, location) may be retained for benchmarking purposes, even after project deletion or account cancellation.
Account deletion: Users may delete their account at any time from account settings. Upon deletion, all personal data and project data are permanently removed. Anonymised benchmark data is retained as described above.

Your use of the Service is also subject to the terms and policies of these providers where applicable.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Recruitella uses artificial intelligence to assist with candidate selection. AI can and does make mistakes. All scores, rankings, and summaries are advisory only and must not be treated as definitive assessments. The final hiring decision is always the responsibility of the human user. We do not guarantee the accuracy, completeness, or suitability of any AI-generated output.
To the maximum extent permitted by applicable law, DMKode shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or related to the use of the Service.
Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
You agree to indemnify and hold harmless DMKode, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We aim to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications to the Service at any time.
We reserve the right to modify, suspend, or discontinue any feature of the Service. If we make material changes that negatively affect your paid subscription, we will provide reasonable notice.
We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Slovak Republic and applicable European Union regulations.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Slovak Republic, without prejudice to any mandatory consumer protection provisions of your country of residence.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
